- General
Sky-Mania Paragliding conducts tandem paragliding flights. The company named on the flight ticket, which is filled out before the tandem flight, is considered the organizer and contracting party. The flight ticket also serves as the invoice for the service.
The transportation of persons in the tandem paraglider and all other services provided by Paragliding Zell am See are subject to Austrian law, particularly the aviation regulations, as well as the following conditions.
Before the flight, the passenger (or a guardian or an adult accompanying person in the case of children) must carefully read the transportation contract and confirm it with their signature. Immediately before the start, the passenger will be briefed by the pilot on the starting procedures. If the passenger does not understand this briefing or cannot comply with it for any reason, they must inform the pilot immediately.
- Insurance and Liability Limitations
A legally required liability insurance is in place for the benefit of the tandem passenger and the items they carry with them.
Sky-Mania Paragliding is only liable for damages if the damage was caused intentionally or through gross negligence by Sky-Mania or the persons employed to fulfill the transportation contract. Liability is not assumed if all necessary measures to prevent the damage were taken by the carrier and its people or if these measures could not be taken. The carrier's liability for the passenger's carried items is limited to the amount covered by the insurance. Further claims can only be made in cases of intent or gross negligence.
The passenger is responsible for shockproof packaging of carried photo and film equipment as well as other valuables. The items must be secured so that loss during the flight is impossible. Sharp, pointed, or glass objects, weapons, pressurized containers, explosives, and pyrotechnic devices are not allowed on the flight.
Sky-Mania Paragliding is not liable for damages occurring on the way to the launch site and from the landing site.
The exclusion or limitation of liability also applies to employees, independent tandem pilots, and agents of Sky-Mania Paragliding.
Duty to Report Health Impairments
The passenger must inform Sky-Mania Paragliding and the tandem pilot if their health condition poses an increased risk for them or limits their movements, potentially increasing the risk of injury during takeoff and landing.
The following must be reported in any case:
Serious accidents within the last 12 months.
Limitations in the musculoskeletal system.
Serious diseases of the heart, spine, intervertebral discs, high blood pressure, organ diseases, or similar conditions. A disease is considered serious if one has been or is under medical treatment.
Mental or psychological defects suffered from or still suffering within the last 12 months.
Alcohol consumption within the last 12 hours.
In case of doubt about their fitness to fly, the passenger is obliged to inquire about their suitability with Sky-Mania Paragliding.
Equipment
The passenger agrees to wear appropriate clothing (according to the season), preferably sturdy shoes (covering the ankles), and gloves. Note that temperatures on the mountain are usually lower than in the valley. Long pants and a jacket are recommended even in summer. Sky-Mania Paragliding provides helmets and flight equipment.
Dates and Execution
Sky-Mania Paragliding offers tandem flights almost year-round. Restrictions arise due to weather conditions and the operating times of the mountain railways. For reservations, please call 4-5 days in advance.
Despite agreed dates, there is no entitlement to the flight if weather conditions at the flight area do not permit it. In case of postponements or cancellations, there is no claim for damages, refunds, or reimbursement of other expenses. However, the right to reschedule the flight remains. Sky-Mania Paragliding strives to provide timely information about the feasibility of the flight.
Weather-related cancellations do not require objective evidence; the subjective impression of the responsible pilot is sufficient.
The flight duration depends on various weather influences, meaning no uniform flight time can be guaranteed.
The passenger must follow the pilot's instructions during takeoff, landing, and the flight.
Payment Terms / Validity of Vouchers
The purchaser of a voucher commits to paying the purchase price within 7 days without deduction after receiving the voucher. For booking a tandem flight without a voucher, the flight price is payable in cash immediately after the flight.
Vouchers expire 36 months after the issue date. Special arrangements can be made on an individual basis. The voucher/tickets must be brought on the flight day (or as a PDF on a mobile phone) and shown to the pilot.
- Right of Withdrawal
Claims for refund of the purchase price exist under the KSchG within 14 days of receiving the voucher without giving reasons. Returning the voucher within this period is sufficient.
Cancellation Fees
The passenger can withdraw from the agreed date by emailing info@sky-mania.com at any time. Cancellations up to 4 days before the booked date are free of charge. From 3 days to 24 hours before, a 50% cancellation fee applies. Vouchers and tickets become invalid with a cancellation and will be valid again upon receipt of the cancellation payment. Refund of the remaining purchase price is excluded. This also applies to vouchers/tickets from distribution partners. For cancellations within 24 hours, the cancellation fee is 100%. Vouchers and tickets are counted as "no show."
Right to Use Photos and Videos
The passenger expressly agrees to the use of photos and videos taken by Sky-Mania Paragliding or its pilots during or of the flight for advertising purposes, etc.
Texts, images, and graphics, both printed and on this website, may only be used with the explicit permission of the owners.
Risk Advisory
We point out that despite the utmost care and optimal flight conditions, accidents with significant injury consequences (e.g., sprains, fractures, cervical spine contusions, spinal injuries, concussions, in extreme cases, death) cannot be ruled out when paragliding. There is an increased risk during takeoff and landing due to incorrect landings, stumbles, or falls.
Final Provisions
Austrian law exclusively applies to all disputes arising from this transportation contract. The exclusive jurisdiction is the district or regional court responsible for 5700 Zell am See.
Should individual provisions of the GTC be ineffective, the effectiveness of all other points remains unaffected. An appropriate regulation that most closely matches the ineffective provisions should take their place.
